Manifestation Determination
Manifestation determination is a process during the IEP meeting that determines whether the student's behavior was or was not a "manifestation of the student's disability". A student with a disability who violates a school policy can be taken out of the school setting for no more than 10 days while the school and parents meet in an IEP team meeting to evaluate the situation. Before the meeting can occur, the team must review the current IEP, observations, diagnostic results, and other relevant information to the occurrence. The team will then decided whether the failed implementation of the IEP was the reason for the behavior or if it was a random occurrence. If there is not enough information, the team will have a difficult time pin pointing where the problem stemmed from and the team will not be able to provide everything the student needs. If the student does not have a behavior plan, the team can then decide if there is a need for one.
